Terms of Service

These Terms of Service are an agreement between you and OzarksMade about your use of the Messages by OzarksMade app. In these Terms, "Messages", "the app", "we", "us", and "our" refer to Messages by OzarksMade, and "you" and "your" refer to the person using the app.

Acceptance of these Terms

By downloading, installing, or using Messages, you agree to these Terms of Service. If you do not agree, please do not use the app. We may update these Terms from time to time; when we do, we will post the updated version on this page, and your continued use of the app means you accept the changes.

What the app does

Messages is an Android app for sending and receiving SMS and MMS text messages. It can optionally connect to Google Messages (Companion Mode) to display your RCS chats. Delivery of your messages depends on your device, your mobile carrier, and, if you enable it, Google Messages, which are services that we do not control.

Your responsibilities

When using Messages, you agree that:

• You will comply with all applicable local, state, federal, and international laws.
• You will not use the app to send spam, to harass or threaten others, or for any unlawful, fraudulent, or abusive purpose.
• You are solely responsible for the content of the messages you send and for the people you choose to contact.
• You will keep your device secure, since your messages are stored on it.

Message and data charges

Sending and receiving SMS and MMS messages may incur charges from your mobile carrier at their standard rates. RCS chats, backups, and app updates may use mobile data or Wi‑Fi. You are responsible for any charges from your mobile carrier or internet provider that result from using the app.

Third‑party services

Messages works alongside services that we do not own or control, including your mobile carrier and, in Companion Mode, Google Messages and your Google Account. Your use of those services is governed by their own terms and policies, and we are not responsible for them.

Availability and changes

We may add, change, or remove features, and we may update, suspend, or discontinue the app or any part of it, at any time and without notice. We aim to keep the app working well, but we do not guarantee it will always be available or uninterrupted.

No warranty

Messages is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the app will be free of errors or bugs, that every message will be delivered, or that the app will meet your requirements.

Limitation of liability

To the fullest extent permitted by law, OzarksMade will not be liable for any indirect, incidental, special, or consequential damages, or for any lost, delayed, or undelivered messages, arising out of or relating to your use of the app, or your inability to use it.

Governing law and disputes

These Terms are governed by applicable United States federal law and the laws of the state in which OzarksMade operates, without regard to conflict‑of‑law rules. Any dispute arising out of or relating to these Terms or your use of the app will be handled in the courts of that jurisdiction.
