Governing the Messages by OzarksMade application and the OzarksMade RCS service.

These Terms of Service (the "Terms") form a binding agreement between you and OzarksMade ("OzarksMade", "we", "us" or "our") governing your access to and use of the Messages by OzarksMade application and the services described in section 4. Please read them carefully and retain a copy for your records.
By downloading, installing, accessing or using the Application, you accept these Terms. If you do not accept these Terms, you must not install or use the Application. If you use the Application on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and references to "you" include that organization.
You must be at least 13 years of age to use the Application. If the laws of your jurisdiction require a higher minimum age for a person to consent to the processing of personal data or to enter into a binding agreement, you must have attained that age. You represent that you meet the requirements of this section and that you are not barred from receiving the Services under the laws of any applicable jurisdiction.
The OzarksMade RCS Network is an independent network. It is not interconnected with Google Messages RCS, with any mobile network operator's RCS service, or with any other Rich Communication Services network, and no message sent over the OzarksMade RCS Network is delivered to a recipient on any such network as a chat message. Where the recipient is not registered on the Network, the Application transmits the message by Text Messaging.
OzarksMade may seek interconnection with other networks in the future. No such interconnection exists, no agreement for it has been concluded, and no date for it has been fixed. Nothing in these Terms, on the OzarksMade website, or in any statement made by OzarksMade constitutes a representation, warranty or commitment that interconnection will be established, and you must not rely upon any such expectation in deciding whether to purchase the Application or any Subscription.
Registration on the OzarksMade RCS Network requires verification that the phone number presented by your device is held by you. Verification is performed by the exchange of a short message between your device and a number operated by or on behalf of OzarksMade, together with a verification code that is valid for a single session. You consent to that exchange. The message may be transmitted using your mobile network operator's service and may be charged by that operator at its standard rates.
A verification, once completed, remains valid for a limited period and is repeated from time to time. Where verification cannot be completed or has expired, Chat Features, Sync, Continuity and Presence will be unavailable for the affected number until verification is completed. Text Messaging is unaffected.
The Application verifies, on each launch, that it is an unmodified copy obtained from Google Play and that it is executing on a device whose operating system has not been modified. This requirement exists because the Application holds the credentials by which your phone number is identified on the Network, and because a modified device may permit those credentials to be intercepted or diverted.
Where verification does not succeed, the Application operates in read-only mode. In read-only mode, existing conversations remain accessible and no data is deleted, but the composer is disabled and no message may be sent, whether by Text Messaging or by Chat Features. Devices that have been rooted, that execute a modified operating system distribution, or on which instrumentation frameworks are present, and installations that have been repackaged, re-signed, obtained otherwise than from Google Play, or obtained without a valid licence, will not pass verification. OzarksMade does not undertake to provide any means of circumventing this section.
Subject to your compliance with these Terms, OzarksMade grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use one copy of the Application on each Android device that you own or control, for your own non-commercial use. All right, title and interest in and to the Application and the Services, including all intellectual property rights, remain with OzarksMade and its licensors. No right is granted other than as expressly set out in this section.
You must not, and must not permit any other person to: copy, modify, adapt, translate or create derivative works of the Application; reverse engineer, decompile or disassemble the Application, except to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction; remove, obscure or alter any proprietary notice; rent, lease, lend, sell, redistribute or sublicense the Application; or access the Services by any means other than the Application or a client authorized in writing by OzarksMade.
Companion Mode, being the feature by which the Application formerly displayed conversations obtained from the Google Messages application installed on the same device, has been discontinued. Google amended the conditions upon which an application may pair with Google Messages, and OzarksMade has declined to satisfy those conditions on behalf of its users. The reasons are set out in the service notice. The Chat Features described in section 4.2 replace Companion Mode. Text Messaging is unaffected by the discontinuation, and message history held on your device is not deleted by reason of it.
You must not use the Application or the Services:
You are solely responsible for the content of every message you transmit and for the recipients you select.
OzarksMade claims no ownership of the content of your messages. OzarksMade does not use the content of your messages for advertising, does not sell it, and does not use it to construct a profile of you. To the extent necessary to operate the Services, you grant OzarksMade a limited licence to transmit, store and reproduce the content of your messages solely for the purposes of delivering them, of making them available to the devices registered to your number where Sync is enabled, and of maintaining the Services. That licence is limited to those purposes and terminates when the content is deleted in accordance with the Privacy Policy.
The Services operate in conjunction with services that OzarksMade does not own or control, including your mobile network operator, Google Play, the Android operating system and the message transmission provider identified in the Privacy Policy. Your use of those services is governed by their own terms, and OzarksMade is not responsible for them. Businesses that send messages by means of the Network are responsible for their own conduct and for their own handling of information you provide to them.
OzarksMade may add, alter, suspend, withdraw or discontinue the Application, any Service or any feature, in whole or in part, at any time. Where a change materially and adversely affects a Service for which you hold a paid Subscription, OzarksMade will give reasonable advance notice by means of the Application, this website, or the electronic mail address you have provided, except where the change is required for reasons of law, security or the integrity of the Services. OzarksMade does not warrant that the Services will be available without interruption or free from error, and may suspend the Services for maintenance.
These Terms take effect upon your first use of the Application and continue until terminated. You may terminate at any time by ceasing to use the Application and uninstalling it, and by cancelling any Subscription through Google Play.
OzarksMade may suspend or terminate your access to the Services, in whole or in part, where you materially or repeatedly breach these Terms, where required by law or by an order of a competent authority, where necessary to protect the Services or their users, or where the Service is discontinued. Where reasonably practicable, OzarksMade will give notice and an opportunity to remedy the breach, unless to do so would be unlawful, would compromise an investigation, or would risk harm to another person or to the Services.
Upon termination, the licence granted in section 8 ends. Sections 11, 12, 16, 17, 18, 19 and 21 survive termination. Data stored by OzarksMade is retained and deleted in accordance with the Privacy Policy.
To the fullest extent permitted by applicable law, the application and the services are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory. OzarksMade expressly disclaims all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from a course of dealing or usage of trade.
Without limiting the foregoing, OzarksMade does not warrant that the application or the services will be uninterrupted, secure or free from error, that any defect will be corrected, that any particular message will be transmitted, delivered, delivered without delay, or retained, or that any delivery notification, read notification, composing indication or presence indication will be accurate or timely.
The application and the services are not an emergency communication service. The Application does not support calls or messages to emergency services, and must not be relied upon for any purpose where failure of delivery could result in death, personal injury, or damage to property or the environment.
Some jurisdictions do not permit the exclusion of implied warranties, and in those jurisdictions the foregoing exclusions apply to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, OzarksMade shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profits, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with these Terms, the Application or the Services, whether in contract, tort (including negligence), strict liability or otherwise, and whether or not OzarksMade has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the aggregate liability of OzarksMade arising out of or in connection with these Terms, the Application and the Services shall not exceed the greater of (a) the total amount paid by you to OzarksMade, or to Google in respect of the Application and Subscriptions, in the twelve months preceding the event giving rise to the liability, or (b) twenty United States dollars (US $20.00).
Nothing in these Terms excludes or limits the liability of OzarksMade for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that may not lawfully be excluded or limited. Some jurisdictions do not permit the exclusion or limitation of certain damages, and in those jurisdictions the foregoing applies to the fullest extent permitted by law.
You shall indemnify and hold harmless OzarksMade and its officers, employees and agents from and against any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of or in connection with the content of any message you transmit, your use of the Application or the Services in breach of these Terms, or your violation of any law or of the rights of any third party.
These Terms and any dispute arising out of or in connection with them, the Application or the Services are governed by the laws of the State of Missouri and the federal laws of the United States of America, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
The state and federal courts situated in the State of Missouri shall have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts, save that either party may bring an action in a court of competent jurisdiction to restrain the infringement of its intellectual property rights. Nothing in this section deprives a consumer of the protection of any mandatory provision of the law of the jurisdiction in which that consumer is resident, including the right to bring proceedings in that jurisdiction.
Before commencing proceedings, each party shall notify the other in writing of the dispute and shall allow thirty days for it to be resolved by negotiation. Notice to OzarksMade may be given to messages@ozarksmade.net.
OzarksMade may amend these Terms to reflect changes to the Application or the Services, changes in applicable law, or changes required for security or operational reasons. The amended Terms will be published on this page and the date at the head of the document will be revised. Where an amendment is material and adverse to you, OzarksMade will give reasonable advance notice before it takes effect, except where the amendment is required by law or is necessary to address a risk to security or to the Services. Your continued use of the Application after an amendment takes effect constitutes acceptance of it. If you do not accept an amendment, you must cease using the Application and cancel any Subscription.
